We are transparent about what we do with your personal data so that you understand the implications of how we’ll use it, as well as the rights you have as a user of our platform. Therefore, we permanently provide you with all the relevant information in this Privacy Policy, which you can consult whenever you deem it appropriate.
1. Who is responsible for processing your personal data?
In accordance with Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights (LOPD), and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/CE, you are informed that the personal data you provide through the website www.spherag.com will be processed confidentially and will become part of the files owned and managed by:

2. What types and categories of personal data do we process?
The categories of data that will be processed by SPHERAG are:
- Identification data, professional contact information, and language preferences.
- Connection and Browse data.
- Geolocation and camera access data.
- Billing and payment data.
Within each of these data categories, you’ll find the following types of data that we’ll request from you or that you’ll provide us with at some point in our relationship:
- Identification data, professional contact information, and language preferences: Name and surname, postal address, shipping address, phone number and email address, company name, registered office, Tax ID (NIF), and professional contact details.
- Connection and Browse data: In this case, we may access your device’s IP address, device identification code, and metadata.
- Geolocation data: Location of the farm, cadastral reference, location of the various sensors installed on the farm to send data to the SPHERAG platform in real-time.
- Billing and payment data: Billing address, bank account number, and bank details. Data necessary to issue and complete an invoice. Payment or card details are not stored or collected in our systems; instead, the data is sent directly via the payment gateway to the payment service provider.
In no case are special categories of personal data, as defined in Article 9 of the General Data Protection Regulation, processed. Such data is provided by the User.
3. For what purposes will your personal data be processed?
Your personal data will be used by SPHERAG for the following purposes:
- Management and control of user registration and any requests, subscriptions, or other contracts that the user makes on the Website, in accordance with the applicable terms and conditions in each case and the provisions of this policy.
- Management and control of the advertising preferences indicated by the User during registration, which can be modified at any later time.
- Improvement of the website and the platform, as well as the sending, by traditional and/or electronic means, of commercial and advertising information about SPHERAG products and services.
- Managing and responding to requests or queries through any means enabled by SPHERAG, contacting the user in relation to such requests or queries, and forwarding them to the corresponding department.
- Management and control of user registration and any requests, subscriptions, or other contracts that the user makes on the platform, in accordance with the applicable terms and conditions in each case and the provisions of this policy.
- User management of the technological and digital tools contained in the SPHERAG Platform.
Notwithstanding the foregoing, on certain occasions, the data collection form for specific services may inform about a purpose different from those indicated in the preceding sections. For this reason, we ask you to review our legal texts before finalizing any subscription or contracting process for products or services.
As you will see in our cookie policy, we use technologies similar to cookies, such as pixels. The commercial communications we send you by email contain tracking pixels that allow us to check whether you have opened the email or not, as well as other information such as access time, browser type, operating system, or the IP address from which you connect. In relation to sending advertising, we expressly inform you that we do not make automated decisions with effects on the user.
We also use Meta and Google marketing tools when marketing our products and services to potential customers.
4. How long will we retain your personal data?
Your personal data will be retained for the minimum time necessary for the purposes of its processing and, in any case, until the User requests its deletion.
Regardless of whether we process your personal data for the strictly necessary time to fulfill the stated purposes, we will subsequently keep it duly stored and protected for the period during which liabilities arising from the processing may arise, in compliance with the regulations in force at all times. Once any possible actions in each case expire, we will proceed to delete the personal data.
5. What is the legal basis for processing your personal data?
Regarding the legitimacy of processing, two scenarios are distinguished:
- If the processing of personal data is carried out for the purpose of providing you with the requested services, in this case, the contract will be the legal basis.
- If the processing of personal data is carried out for the purpose of sending you communications regarding news, products, as well as to attend to your requests or inquiries, in this case, the legal basis for the processing will be the consent expressly given by the User.
6. Will we transfer your personal data outside of Spain?
Given that, as indicated in our Cookie Policy, we use tools from Google, Inc., with headquarters in the United States at 1600 Amphitheatre Parkway, Mountain View, California 94043, we inform you that our providers may process your personal data in countries outside the EEA based on an adequacy decision of the European Commission or on standard contractual clauses approved by the European Commission and incorporated into our agreements. 7. What are your rights when you provide us with your personal data?
SPHERAG informs you that you can exercise your rights of access, rectification, erasure, restriction of processing, data portability, or objection by sending an email to dpo@spherag.com or a letter to SPHERAG TECK IOT, S.L., Av. de Gómez Laguna, 25, Planta 10, Oficina 1B, 50009 Zaragoza, along with a photocopy of your National Identity Document.
Specifically, the rights you have are:
- Right of access to personal data: You have the right to obtain a copy of the personal data that SPHERAG holds about you and information on how we use it. Generally, these requests will be processed free of charge for the User.
- Right to rectification: You can ask SPHERAG to update or rectify your personal data.
- Right to erasure: You can ask us to delete your data. Please note that such cancellation may mean that we have to stop providing you with certain services.
- Right to object and to restriction of processing: You can object to the processing of your personal data, or request that it not be used for specific purposes.
- Right to data portability: Provided that the necessary requirements are met, you can request your personal data in a commonly used electronic format, and that it be transmitted to another third party of your choice.
- Right not to be subject to an automated decision (including profiling): You have the right not to be subject to a decision based solely on automated processing.
- Right to withdraw consent: If you have given us your consent for specific data processing, you can withdraw it at any time.
Likewise, if you believe that the processing of your personal data does not comply with the regulations or your privacy rights, you are also informed of your right to file any complaint you deem appropriate with the Spanish Data Protection Agency.
The User will have the right to withdraw their consent at any time. We expressly inform you that failure to complete the fields indicated as mandatory in any electronic registration form may result in SPHERAG being unable to process your request.
The User guarantees that the personal data provided to SPHERAG is truthful and is responsible for communicating any modification to it. The User will be solely responsible for any direct or indirect damage or harm that may be caused to SPHERAG or any third party due to the completion of forms with false, inaccurate, incomplete, or outdated data. The User must not include personal data of third parties without their prior informed consent of what is established in this privacy policy, being solely responsible for their inclusion.
For its part, SPHERAG has adopted the necessary measures to prevent the alteration, loss, unauthorized processing, or access of personal data, taking into account at all times the state of technology, the nature of the data stored, and the risks to which they are exposed, whether they originate from human action or from the physical or natural environment. However, the User must be aware that security measures on the Internet are not impregnable.
8. Changes to the Privacy Policy
SPHERAG reserves the right to modify its privacy policy according to its criteria, or due to a legislative, jurisprudential, or business practice change. If SPHERAG introduces any modification, the new text will be published on this same website, where the User will be able to learn about the current privacy policy. In any case, the relationship with users will be governed by the rules in force at the precise moment the website is accessed. 9. Information about Cookies
For the purposes of what is indicated in the previous paragraph, SPHERAG informs that it has cookies installed on its systems.
